Terms of Service

These Terms of Service ("Terms") govern your use of the MobileFoods mobile application and related services (together, the "Service"), operated by MobileFoods Technologies ("MobileFoods", "we", "our", or "us"), a business registered in Nigeria. By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What MobileFoods Is

MobileFoods is a marketplace platform that connects three groups of users in Nigeria: customers who order food, independent restaurants that prepare it, and independent delivery riders who deliver it. MobileFoods is an intermediary. We do not prepare food, we do not employ riders, and we are not a party to the sale between you and a restaurant beyond facilitating it. Restaurants are solely responsible for the preparation, quality, and safety of the food they sell. Riders are solely responsible for the conduct of each delivery they accept.

Refunds are issued to your MobileFoods wallet, an in-app balance you can spend on any future order. Wallet credits are applied instantly. Refunds to your original payment method are not automatic; if you need one, contact support and we will review it case by case.

We may suspend or terminate accounts that violate these Terms, with any legitimately earned balances paid out and any fraudulent credits reversed.

8. Service Availability

MobileFoods currently operates in parts of Ogun State and Lagos, Nigeria. Delivery availability depends on your address, restaurant opening hours, and rider availability. The Service is provided "as is"; we do not guarantee uninterrupted availability and may modify or discontinue features at any time.

9. Liability

To the maximum extent permitted by law, MobileFoods' total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded under Nigerian law.

10. Privacy

Our Privacy Policy explains what data we collect and how we use it, in accordance with the Nigeria Data Protection Act (NDPA) 2023. It forms part of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing Law and Contact

These Terms are governed by the laws of the Federal Republic of Nigeria.
